Proposed Change 220139 To The Operative South Waikato District Plan
The South Waikato District Council has received a request from J & T Quigley Ltd under Clause 21 of the First Schedule to the Resource Management Act 1991 (the Act) for a Proposed Change (RM220139) to the South Waikato District Plan.
The change requested would alter the zoning of 31.68 ha of land at 1861 Ongaroto Rd (SH30) Whakamaru from General rural zone to Rural lifestyle zone. Seven amendments are requested, bespoke to this land, to the District Plan’s subdivision rules, the Rural lifestyle zone rules, and the plan’s Assessment Criteria for Discretionary Activities.
The proposed plan change can be inspected during business hours at the following locations:
- Council Office, Torphin Crescent, Tokoroa
- Tīrau Information Centre, State Highway 1, Tīrau
- Tokoroa Public Library, Leith Place, Tokoroa
- Putāruru Public Library and Service Centre, Overdale Street, Putāruru

Any person may make a submission on the proposed change. You may do so by sending a written submission to South Waikato District Council at Private Bag 7, Tokoroa, or email: submissions@southwaikato.govt.nz. Submissions must be in a specific format (RMA Form 5), and must state whether or not you wish to be heard on your submission. Copies of this form are available from Council’s offices, and on Council’s website www.southwaikato.govt.nz.
Submissions close on Monday 12 May 2025 at 5pm.
The proposed rezoning may have actual or potential cultural effects. To identify the nature and extent of any cultural effects, the Applicant commissioned the relevant iwi authority in 2023 to provide a Cultural Impact Assessment (Cultural Report) but this has not yet been received from iwi. To avoid further delays, the application is being notified without the Cultural Report being available. Submitters should be aware a Cultural Report may still be forthcoming before a decision is made on the application. Submitters may address cultural effects in their submission notwithstanding the absence of a Cultural Report.
The process for public participation in the consideration of Plan Changes under the Act is as follows:
- after the closing date for submissions, the South Waikato District Council must prepare a summary of the submissions and this summary must be publicly notified; and
- there must be an opportunity to make a further submission in support of, or in opposition to, the submissions already made; and
- if a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
- the South Waikato District Council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
- any person who has made a submission has the right to appeal the decision on the proposal to the Environment Court.
